The terms that govern your use of DFH Recovery Services and our surplus funds recovery process.

These Terms of Service ("Terms") govern your use of dfh-recovery-services.polsia.app (the "Site") and the surplus funds recovery services provided by DFH Recovery Services ("we," "us," or "our"). By using the Site or submitting a claim inquiry, you agree to these Terms. If you do not agree, do not use the Site.

1 Service Description

DFH Recovery Services helps individuals and their heirs identify and recover surplus funds — money left over after a property is sold at a tax sale or foreclosure for more than the amount owed. Our service includes:

✅ We charge no upfront fees. Our fee is only collected if and when funds are successfully recovered on your behalf.

2 Fee Schedule

Our contingency fee is calculated as a percentage of the gross amount recovered. The applicable rate is determined by the claim amount recovered:

Tier 1 Up to $5,000 40%
Tier 2 $5,001 – $15,000 35%
Tier 3 $15,001 – $30,000 30%
Tier 4 $30,001 – $60,000 25%
Tier 5 $60,001 – $100,000 20%
Tier 6 Over $100,000 15%

The fee percentage is applied to the gross amount recovered. Attorney fees for any required legal proceedings are separate and will be disclosed to you before you commit to retaining legal representation. You keep the remainder after our fee is deducted.

3 No Guarantee of Recovery

Important: Submitting a claim inquiry does not guarantee recovery of funds. Surplus fund claims are subject to legal procedures, deadlines, competing claims, and court review. DFH Recovery Services makes no representation that funds will be recovered in any particular amount or timeframe.

We will inform you promptly if we determine that a claim is unlikely to proceed, and you will incur no fee in that case.

4 Your Responsibilities

To use our services, you agree to:

Submission of false or misleading information may result in termination of our services and, where applicable, may be referred to appropriate legal authorities.

5 Intellectual Property

All content on this Site — including text, graphics, logos, data compilations, and code — is the property of DFH Recovery Services or its licensors. You may not reproduce, distribute, or create derivative works from any content on this Site without our express written permission.

Our surplus funds database is compiled from publicly available government records. The database as a whole, including its organization and presentation, is proprietary to DFH Recovery Services.

6 Disclaimer of Warranties

THE SITE AND ITS CONTENTS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

7 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DFH RECOVERY SERVICES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR OUR SERVICES, INCLUDING LOST PROFITS, LOSS OF DATA, OR FAILURE TO RECOVER CLAIMED FUNDS.

Our total cumulative liability to you for any claim arising out of or related to these Terms or our services shall not exceed the amount of fees, if any, actually paid by you to DFH Recovery Services.

8 Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law provisions.

Any dispute arising from or related to these Terms or our services shall be resolved as follows:

  1. Informal resolution — Contact us at customerservice@dfhrs.com. We will make a good-faith effort to resolve the dispute within 30 days.
  2. Mediation — If informal resolution fails, either party may request non-binding mediation in Atlanta, Georgia, before a mutually agreed mediator.
  3. Litigation — If mediation fails, disputes shall be resolved in the state or federal courts located in Fulton County, Georgia, and you consent to personal jurisdiction in those courts.

Nothing in these Terms prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction.

9 Termination

We may terminate or suspend your access to the Site and our services at any time, with or without cause or notice, including if you violate these Terms. Upon termination, any pending claim inquiries you have submitted will be handled in accordance with any separate written agreement, if applicable.

You may discontinue use of our services at any time by notifying us at customerservice@dfhrs.com. If no claim has been filed on your behalf, no fee will be owed.

10 Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms. If we make material changes, we will make reasonable efforts to notify you (e.g., via email if you have submitted a claim).
